Vendor Terms of Service
The Appomattox Community and Disaster Relief Organization welcomes you as a participant at our events. We hope that your time with us is enjoyable and profitable for your business. The following Vendor Terms of Service applies to all events hosted by the Appomattox Community and Disaster Relief Organization, and/or Appomattox Events, unless a specific event explicitly modifies it.
Vendor Registration and Classification
Vendors must register for a vendor management account on our website at https://vendor.appomattoxevents.com providing their business/vendor name, first and last name, contact phone number, email address, business description and selecting a vendor registration type. The following vendor types are classified by the Appomattox Community and Disaster Relief Organization for its events, and vendors must choose a vendor type based on the following criteria:
Artisan or Crafter: this vendor classification is applicable only to vendors who sell handmade items of an artisan/couture/bespoke quality, which were created or crafted by the vendor. Examples would include, but are not limited to, handmade soaps, handmade cosmetics, handmade skincare products, custom woodworking pieces, custom sewn/knitted/crochet clothing, original works of art or prints of original works of art made by the vendor.
Business Vendor: this vendor classification is applicable to any business that sells products or services in a business to consumer model and does not meet the criteria of any other vendor classification listed. Examples would include all independent consultant businesses (i.e., Scentsy, Mary Kay, Cutco, LuLaRoe, etc.), any business selling premanufactured/purchased for resale merchandise (i.e., mass produced food spices, rubs or sauces, cups, tumblers, signs, posters, t-shirts, clothing, etc.), and any business selling or presenting services for hire (i.e., contracting, consultancy, tax and legal services, real estate, vacation services, IT and internet services, telecommunications services, etc.).
Non-Profit Organization: this vendor classification is applicable only to vendors which have presented the Appomattox Community and Disaster Relief Organization with proper tax-exempt status certification from the Internal Revenue Service, or the Commonwealth of Virginia.
Full-Service Food: this vendor classification is applicable to any business which provides food services, such as food trucks, restaurants, catering services, etc., selling meals to event attendees.
Snack or Dessert Foods: this vendor classification is applicable to any business which provides food services that are not full meal services, such as ice cream vendors, coffee and beverage carts, cotton candy, popcorn, roasted nuts, etc. This vendor classification can only apply to vendors that do not provide meal services. A vendor which provides meals (i.e., sandwiches, chicken, BBQ, etc.) in addition to snack and/or dessert foods is a Full-Service Food vendor.
Brewery: this vendor classification is applicable to properly licensed and registered breweries only. Proof of licensure and regulatory compliance documentation must be submitted before a vendor management account will be approved.
Distillery: this vendor classification is applicable to properly licensed and registered distilleries only. Proof of licensure and regulatory compliance documentation must be submitted before a vendor management account will be approved.
Winery or Cidery: this vendor classification is applicable to properly licensed and registered wineries and/or cideries only. Proof of licensure and regulatory compliance documentation must be submitted before a vendor management account will be approved.
Sponsor: this classification is used specifically to register an account as a sponsor only, with no intention of purchasing vendor space at an event. Approved vendors automatically have access to sponsorship opportunities with an approved vendor management account. If you want to be a vendor at an Appomattox Community and Disaster Relief Organization event, please register as a vendor with one of the vendor classifications listed above. If you plan to only purchase event sponsorships without the option to purchase vendor space at events, chose the Sponsor vendor type.
General Rules
Items are prohibited from being displayed or sold during our events:
-Yard sale or flea market type items (used, worn, secondhand items).
-Snap pops, fireworks, or any other items containing explosive material.
-Air guns, BB guns, pellet guns or working firearms of any kind (except for FFL registered dealers conducting business at our Appomattox Outdoor Expo event.
-Items that display profanity, racism, hate speech, or are deemed offensive by the event staff.
-Alcohol and drugs other than wine, beer or distilled alcohol that is allowed pursuant to an ABC license and distributed by properly licensed breweries, wineries, distilleries, or otherwise licensed vendors.
-Any other item deemed dangerous or offensive by any member of the event staff.
Vendor Space
All items that you have for sale, distribution, or display must be contained within your vendor space. You may not display or hang any items outside your allotted space, on or in any of the buildings, fencing, or other displays belonging to the Appomattox Community and Disaster Relief Organization, or the event venue property owner unless prior approval is obtained from event staff.
Permits/Licenses/Insurance Needed
You the vendor are solely responsible for obtaining any permits/licenses/insurance (Health Dept., ABC, etc.) required to conduct business at the event. Failure to obtain the proper permits/licenses/insurance required will prevent you from participating in the event. Copies of all permits/licenses/insurance must be sent to the Appomattox Community and Disaster Relief Organization via postal mail to: PO Box 2835 Appomattox, VA 24522-2835, OR via email to info@appomattoxcares.org, at least two (2) weeks prior to the event date. Failure to do so can result in you not participating. Failure to provide licensure before the event does not constitute a right to a refund of vendor fees.
Tax Collection
You, the vendor, are solely responsible for any items that you sell and the collections and reporting of any applicable sales or other taxes. The Appomattox Community and Disaster Relief Organization will not collect or report any taxes on your behalf.
Disclaimer
The Appomattox Community and Disaster Relief Organization and our event venue partners cannot, and will not, assume any responsibility for any lost, damaged, stolen or destroyed work, material, product, or equipment attended or unattended, before, during or after an event, nor is the Appomattox Community and Disaster Relief Organization or our event venue partners responsible for any errors or omissions associated with the event.
Compliance
Failure to comply with any of the general guidelines and regulations will result in the event staff requesting you to either bring your space into compliance, or risk being asked to leave the event. Any state or local law enforcement or other regulatory agency will have absolute authority over the governance and operation of our events and may, at their discretion, take any action to enforce laws for which they are responsible. Being removed from an event for failure to comply with these terms and conditions, or for violation of any state or local law enforcement or regulatory agency governance will not constitute a right to a refund of vendor fees. No refunds will be issued.
Agreement and Waiver
To participate in an event, vendors must register for a vendor management account on our website at https://vendor.appomattoxevents.com and purchase vendor space reservations through our online vendor management system. Purchase of vendor space at any of our events constitutes your acknowledgement and agreement to these vendor terms of service and you attest to the following:
i.) I acknowledge that I have read, understand, and agree to the classification of vendor types as stated above, and that purposeful registration as a vendor class that does not reflect my business will result in revocation of my vendor status with the Appomattox Community and Disaster Relief Organization.
ii.) I acknowledge that all vendor spaces at events are available on a first come, first served basis.
iii.) I acknowledge that the Appomattox Community and Disaster Relief Organization provides no guarantee, implied or otherwise, that a vendor will have specific or exclusive rights to the sale, presentation or promotion of any particular product or service, with the exception of such independent consultancy businesses which prohibit more than one independent consultant from selling at a single event (i.e., Scentsy, Mary Kay, LuLaRoe, etc.).
iv.) I acknowledge that the Appomattox Community and Disaster Relief Organization may limit the number of vendor spaces available to certain classes of vendors, at their discretion, for the purposes of providing vendor variety to event attendees.
v.) I acknowledge that by purchasing vendor space I will have made a “good faith” commitment to the Appomattox Community and Disaster Relief Organization, and that my failure to attend or participate as expected will result in forfeiture of any fees paid to the Appomattox Community and Disaster Relief Organization, or its representatives, for any products promised and/or not delivered by the Appomattox Community and Disaster Relief Organization, per the Refund Policy.
vi.) I hereby waive from any liability the Appomattox Community and Disaster Relief Organization, its officers, agents, assigns, Board of Directors, members, committee members, volunteers, sponsors, fellow vendors, and any event venue property owners or agents, due to personal injury, theft, loss, or damage to any property that may occur prior to, during, or after an event.
vii.) I agree to allow the Appomattox Community and Disaster Relief Organization full use of images and other promotional materials (photographs, video, audio, etc.) taken during events for purposes of promoting the Appomattox Community and Disaster Relief Organization and its events.
viii.) I acknowledge that I have read, understand, and agree to comply with the Appomattox Community and Disaster Relief Organization’s Vendor Terms of Service as stated above.
